LICENCE CONDITIONS FOR LICENSEES LICENSED UNDER THE HEALTHCARE SERVICES ACT 2020 (“HCSA”)


           Following the issuance of the MOH Circular 78/2022 titled “Notice of Proposed Modifications to Licence Conditions for Licensees licensed under the Healthcare Services Act 2020 (“HCSA”)” dated 21 Jun 2022, the Director of Medical Services shall modify the conditions of your licence granted under the HCSA (“Licence”) by imposing the appended Licence Conditions on the Retention Periods of Patient Health Records (Annex) for your Licence (Licence Conditions”). These Licence Conditions will take effect from the date of issuance.

2            These Licence Conditions will apply to all persons which have been licensed under the HCSA and are intended to provide further clarity on the minimum durations for which licensees must retain their patients’ health records, in accordance with Regulation 37(1) of the Healthcare Services (General) Regulations 2021. All other conditions of your Licence that have been imposed before the date of this notification shall remain unchanged and in full force and effect, and these Licence Conditions shall be read and construed with the requirements stipulated in the HCSA and its Regulations (including but not limited to the Healthcare Services (General) Regulations 2021, and the Healthcare Services (Advertisement) Regulations 2021).

3            A breach of these Licence Conditions may result in regulatory action being taken against licensees under section 20 of the HCSA, including but not limited to — (a) suspension or revocation of the licensee’s Licence; (b) shortening the term of the licensee’s Licence; 2 (c) directing the licensee to rectify the contravention, or to prevent a recurrence of the contravention; and/or (d) directing the licensee to pay a financial penalty.
